Divorce & Legal Separation

Child Custody & Visitation Rights

During divorce proceedings, the safety and comfort of your child(ren) is of utmost importance. There’s a lot to consider, such as who the child(ren) will live with and how parenting duties will be divided.

There are many different custody options to consider; that’s why we’ll take the time to explain them all to you until you’re 100% comfortable with the arrangement.

If visitation (also called parenting time) is enforced by the court, we can assist with those cases, including both supervised and unsupervised visitation.

Division of Property

Typically, the most disputable aspect of a divorce is the division of property.

Under Michigan law, if you and your spouse can’t come to an agreement about how to divide your property, the judge will decide. However, it’s worth noting that the law requires judges to divide property fairly, meaning that each person gets about half of everything.

Child Support

In Michigan, the family division of circuit courts use an equation to determine who pays what in child support.

Called the Michigan Child Support Formula, it calculates the amount of child support that a non-custodial parent will pay to the custodial parent. This amount is based on the income of both parents, the number of children, and the child custody arrangement.

More often than not, child support is non-negotiable. However, the court can allow parents to forgo using the formula. No matter what, our team will work with you and the court to ensure that your child(ren) will receive adequate support.

Paternity Establishment

If the child(ren) involved in a divorce were born outside of a marriage, it may create issues for establishing paternity. In some cases, a parent may deny any responsibility. In others, they may desire to establish a relationship with the child.

Our attorneys can help establish paternity, and/or obtain any support needed for both the child(ren) and parents.

Prenuptial Agreements

prenuptial agreement (prenup) is designed to specify what each person’s property rights will be if you and your partner should ever reach the decision to divorce.
